Whether it is the victim of a violent crime or a victim of a civil crime, the pain that they feel affects us all. &lt;br /&gt;&lt;br /&gt;When our elected officials do not stand up for the rights of these victims, then they need to be replaced with someone that will. All political officials need to be held accountable to the very people that put them into office.&lt;br /&gt;&lt;br /&gt;We have the constitutional right to vote people into office and in many states and jurisdictions, have the right to remove them from office though the recall process.&lt;br /&gt;&lt;br /&gt;Often times it is a simple problem of promoting someone to their level of incompetency. If an officer is a “good cop” that does not mean they have the training, business or leadership skills to be a sheriff.  If some ones family member was a commissioner or council member, how does that give them the skills to be the same or be in another political office unless they can show, unto themselves, they have the necessary credentials for that office. This also happens with the County Judge’s positions and many other positions of representatives and senators as well.&lt;br /&gt;&lt;br /&gt;Once a person in elected to an office, they are generally there for years. This is the beginning stage of placing the initiative on the 2010 general election ballot.&lt;br /&gt;&lt;br /&gt;This initiative has been labeled ‘Ballot Issue #18’ by the SOS, and is a Constitutional Initiative (CI), seeking to amend Montana’s Constitution, providing for the ability of the citizens to summon &lt;strong&gt;Grand Juries by petition&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;Currently, &lt;strong&gt;the Montana Constitution&lt;/strong&gt; only provides that a District Judge, at their discretion, may summon a Grand Jury. Article II, Section 20, Paragraph 2 states: “A grand jury shall consist of eleven persons, of whom eight must concur to find an indictment. A grand jury shall be drawn and summoned only at the discretion and order of the district judge.”&lt;br /&gt;&lt;br /&gt;Serving as a ‘check and balance’ for the Constitutional Republic known as the United States, the Founders had preserved for the citizens, the right and ability to assure that the public servants kept their activities in line with the intent of the Constitution, and its Bill of Rights, which were ratified on December 15, 1791.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The term Grand Jury&lt;/strong&gt; is mentioned only in the 5th amendment to the United States Constitution. It is meant to be a right retained by the people. It is a citizen function, not a government function, as the public has been lead to believe.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#000099;"&gt;What do the courts have to say?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;“An independent grand jury is to stand between the prosecutor and the accused, and to determine whether a charge is legitimate, or is dictated by malice or personal ill will.”&lt;br /&gt;&lt;br /&gt;”Hale v. Henkel, 201 U.S. 43 (1906)&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Supreme Court states&lt;/strong&gt; that the independent grand jury’s purpose is not only to investigate possible criminal conduct, but to act as a “protector of citizens against arbitrary and oppressive governmental action,” and to perform its functions; the independent grand jury “deliberates in secret and may determine alone the course of its inquiry.”&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#990000;"&gt;United States v. Calandra, 414 U.S. 338 (1974)&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Article IV, Section 4 of The United States Constitution says: “The United States shall guarantee to every State in this Union a Republican Form of Government …” And, Montana is this form of government. As such, &lt;strong&gt;the Montana Constitution states&lt;/strong&gt; in Section 1: “Popular sovereignty. All political power is vested in and derived from the people. All government of right originates with the people, is founded upon their will only, and is instituted solely for the good of the whole.”&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;And, in Section 2:&lt;/strong&gt; “Self-government. The people have the exclusive right of governing themselves as a free, sovereign, and independent state. They may alter or abolish the constitution and form of government whenever they deem it necessary.”&lt;br /&gt;&lt;br /&gt;The Founders’ intended for the sovereign citizens to ‘lend’ the public servants their specific duties. Among these is the preservation of constitutionally protected rights. On behalf the Lincoln County Recall Committee I would like to thank each and every person that signed the petition and every person that helped in the collection of signatures.&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;It has been a journey, one that has allowed us to learn about our constitutional rights and the laws that govern the recall process. We would also like to thank the many government officials that helped us along the way and a special thanks to our legal council for his help and support.&lt;/span&gt;&lt;/p&gt;&lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;Many unresolved questions still remain about the issues involved. It is with our hopes and prayers that one day these issues are brought to light and justice is served upon those deserving.&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;Other questions still to be answered are the concerns and fears of the many people that we spoke to about signing the petition and business owners fearful of hosting the petition in their place of business. To be concerned about the possibility of retaliation or retribution from the very person they have voted into office to protect their safety and property is something that needs to be questioned and answered.&lt;/span&gt;&lt;/p&gt;&lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p style="font-weight: bold;" class="MsoNormal"&gt;&lt;span style="font-size:100%;"&gt;Along the way we have met many people and made many friends. We can only hope that our efforts have encouraged people to think about their vote, who they choose for an office and the candidate’s credentials, training and education. Many of them were drugged, rapped and in some cases raped by multiple men. Some of these women were intimidated by the responding officer, &lt;span style="color:#cc0000;"&gt;embarrassed or too fearful&lt;/span&gt; of continuing victimization to report their assault to anyone other than the victim advocate.&lt;br /&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="color:#cc0000;"&gt;&lt;br /&gt;The 6 women&lt;/span&gt; that did report their assault and filed a complaint with the police had their constitutional right to due process of law stripped from them by an incompetent Sheriff and his department.&lt;br /&gt;&lt;/strong&gt;&lt;strong&gt;&lt;br /&gt;Their lives have changed and they will never be the same because of their horrific experience and worse, they will never see justice. To the best of our knowledge, not one of the 6 reported cases has been prosecuted due to “lack of evidence”!&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;strong&gt;A major crisis event occurred in the lives &lt;span style="color:#cc0000;"&gt;of 11 women in the &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Eureka&lt;/st1:place&gt;&lt;/st1:city&gt; area&lt;/span&gt;. Sheriff Daryl Anderson failed to investigate 6 reported rape crimes completely, if at all. Specifically he failed to adequately investigate a June 26, 2008 rape and failed to secure the crime scene to obtain valuable evidence. Sheriff Anderson also failed to adequately investigate an April 25, 2008 incident where he also failed to secure the crime scene. The Sheriff has also failed to provide rape victims written notice of their rights as set forth in &lt;a href="http://data.opi.mt.gov/bills/mca/46/24/46-24-201.htm"&gt;46-24-201, MCA&lt;/a&gt; He has denied a concealed carry permit without a written statement of the reasonable cause for the denial as required by Section &lt;a href="http://data.opi.mt.gov/bills/mca/45/8/45-8-321.htm"&gt;45-8-321(2), MCA&lt;/a&gt; and testified against HB228 Citizens Self Defense and Firearm Rights Bill. He was also subpoenaed as a DEPUTY for the Henson trial. The date of the subpoena is November 13, 2008, 17 months after he was hired.&lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Lincoln County Recall Committee&lt;/strong&gt; received an anonymous tip that the Lincoln County Sheriff’s department under the supervision of Sheriff Daryl Anderson had employed a deputy that was impersonating an officer.&lt;br /&gt;&lt;br /&gt;It is our understanding that &lt;strong&gt;Jay Charles Sheffield&lt;/strong&gt; was hired as a Deputy Sheriff in Lincoln County by Sheriff Daryl Anderson in June of 2007 and served in this position until he was appointed as a Justice of the Peace in Libby in February 2009.&lt;br /&gt;&lt;br /&gt;We contacted &lt;strong&gt;Wayne Ternes&lt;/strong&gt;, (406 444 9976) Executive Director for the Montana Public Safety Officer Standards and Training (POST) Council in Helena to verify this information. Wayne confirmed that there is no record on file for Jay Charles Sheffield in his system.&lt;br /&gt;&lt;br /&gt;According to Montana State Law, Sheriff Daryl Anderson &lt;strong&gt;was required to submit&lt;/strong&gt; a Hirer/Termination Form to POST within the first 10 days of hiring a new deputy. The new deputy must take the Montana State Equivalency Test, or attend Basic Training if he had not previously served as a Deputy before one year and one day in order to be certified as police officer in the state.&lt;br /&gt;&lt;br /&gt;POST confirmed &lt;strong&gt;they have no records on file for Sheffield&lt;/strong&gt;, never received the Hirer/Termination form, nor do they have any records of him taking the equivalency test or any certification on record. Additionally, we cannot find any record of Sheffield ever being sworn in and taking the Oath of Office as a deputy.&lt;br /&gt;&lt;br /&gt;For the last 7 months in his position as a deputy, &lt;strong&gt;Sheffield had no authority&lt;/strong&gt; to act as an officer as was illegally working in this position impersonating an officer. Subsequently, all complaints and tickets written by Sheffield after one year and one day into his tenured position were taken and/or written illegally. &lt;strong&gt;Those people ticketed now have recourse against the Lincoln County Sheriff’s Department&lt;/strong&gt; and they may request the court dismiss all charges against them, require the county to refund all fines or fees paid and potentially expose the county to lawsuits as a result. Anderson and Sheffield’s disregard of the laws could potentially cost the Lincoln County taxpayers thousands of dollars.&lt;br /&gt;&lt;br /&gt;It is apparent, both &lt;strong&gt;Sheriff Anderson and Deputy Sheffield&lt;/strong&gt; have displayed a reckless disregard for Montana State law.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;A felony impersonation&lt;/strong&gt; of public servant charge carries a penalty of up to five years in prison.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Jay Charles Sheffield&lt;/strong&gt; is now serving as Justice of the Peace in Libby. There is a possibility that he could be in a position to make determinations on tickets that he wrote illegally!&lt;br /&gt;&lt;br /&gt;Sheffield was appointed to the position as Justice of the Peace &lt;strong&gt;by our three County Commissioners &lt;/strong&gt;with the assistance of County Attorney Bernard Cassidy and Sheriff Daryl Anderson. Apparently they too have displayed a reckless disregard for Montana State Law by not verifying information provided by applicants and doing a thorough background check.&lt;br /&gt;&lt;br /&gt;Daryl Anderson’s &lt;strong&gt;blatant disregard of the law&lt;/strong&gt; and the incompetency of the County Attorney and our three County Commissioners are appalling! They have potentially exposed the tax payers to unnecessary lawsuits, complaints and financial loss. It will be interesting to see what research studies have been done on men that rape women that are in a drug induced comatose or near death state physically to see if there are differences in personality traits from one that is just a rapist. Could there be a possibility that this type of personality could be compelled to rape a female corpse?&lt;/strong&gt;&lt;br /&gt;&lt;/p&gt;&lt;/span&gt;&lt;p class="MsoNormal"&gt;&lt;i&gt;&lt;span style="font-family:Arial;"&gt;Another question that needs to be asked is the likelihood of other violent crimes being committed by a person with these personality traits. We know from the research that the majority of the sex offenders started off by abusing animals. We need to find out if a serial rapist, especially one who uses drugs to immobilize their victims would have the propensity to commit other violent crimes and perhaps even murder. &lt;/span&gt;&lt;/i&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;&lt;span style="FONT-WEIGHT: bold;color:#990000;" &gt;PROFILE OF A RAPIST&lt;/span&gt; &lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;Using methods not unlike those employed by FBI profilers to predict the behavior of serial killers, police and forensic psychologists have identified four profiles of rapists defined by motive, style of attack and psychosexual characteristics.&lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;&lt;strong&gt;&lt;span style="color:#990000;"&gt;They are:&lt;/span&gt;&lt;/strong&gt; &lt;/p&gt;&lt;p class="MsoNormal" align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p align="center"&gt;The power-assertive rapist &lt;/p&gt;&lt;p align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p align="center"&gt;The anger-retaliation rapist &lt;/p&gt;&lt;p align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p align="center"&gt;The power-reassurance rapist &lt;/p&gt;&lt;p align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p align="center"&gt;The anger-excitation rapist &lt;/p&gt;&lt;p align="center"&gt;&lt;span style="color:#ffffff;"&gt;s&lt;/span&gt;&lt;/p&gt;&lt;p&gt;Such rapist behaviour profiles provide information that may be helpful in determining how best to respond to a specific kind of attacker. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;These are the characteristics of each of the four rapist profiles:&lt;/strong&gt; &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Power-assertive rapist:&lt;/strong&gt; Athletic, has a "macho" image of himself. More often than not, this is the type who commits date rapes. He typically meets his victim in &lt;strong&gt;a bar or nightclub&lt;/strong&gt;. Instead of targeting a specific victim, he looks for an opportunity to get a woman alone with him, perhaps with an offer of a ride home or an invitation back to his place. Or he may con his victim into trusting him or letting him into her home, perhaps by posing as a policeman or repairman. &lt;/p&gt;&lt;p&gt;&lt;span style="color:#ffffff;"&gt;d&lt;/span&gt;&lt;/p&gt;&lt;p&gt;Approximately 44 percent of rapes are committed by &lt;strong&gt;power-assertive rapists&lt;/strong&gt;. He is physically aggressive, and will use the amount of force needed to control you -- degrading or obscene language, [brandishing] a weapon, slapping or punching -- but he does not intend to kill you. &lt;/p&gt;&lt;p&gt;Generally, begging and crying doesn't work with this guy. If you're going to resist, you've got to be serious. You've got to scream and fight him as hard as you can to get away. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Anger-retaliatory rapist:&lt;/strong&gt; He feels animosity towards women and wants to punish and degrade them. Often he is a substance abuser. He is impulsive and has an explosive temper. He looks for an opportunity to commit the rape rather than for a specific victim. He attacks spontaneously and brutalizes the woman into submission. Thirty percent of rapists fall into the anger-retaliation category. He will grab you from behind and drag you into the bushes. He will often beat you to near-unconsciousness before committing the rape. &lt;/p&gt;&lt;p&gt;&lt;span style="color:#ffffff;"&gt;d&lt;/span&gt;&lt;/p&gt;&lt;p&gt;Any level of resistance may well enrage him and cause him to beat the hell out of you until he gets what he wants. He's not looking to kill you, but the beating could be fatal. You do not want to challenge or enrage this type of rapist. You could try to escape. If you cannot get away or incapacitate the assailant, it's best to submit and try to limit the level of violence of the assault to the extent that you can. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Power-reassurance rapist:&lt;/strong&gt; He lacks the self-confidence and interpersonal skills to develop relationships with women. He is passive and nonathletic. He lives or works near his victim, and "preselects" her by peeping or stalking. He typically breaks into her home in the early hours of the morning and awakens her. He uses minimal force and will threaten her with a weapon, but usually does not have one. He fantasizes that he is his victim's lover so he may ask her to disrobe or to wear a negligee and he will kiss her and engage in foreplay. The power-reassurance type accounts for 21 percent of rapists. He is the least violent type of rapist, and does not intend to hurt or kill you, Among the different types of rapists, he is most likely to be dissuaded if you scream, cry, plead or fight." &lt;/p&gt;&lt;p&gt;&lt;span style="color:#ffffff;"&gt;d&lt;/span&gt;&lt;/p&gt;&lt;p&gt;In general it is more probable that you can discourage a rapist who uses this [power reassurance] approach. But you could instead be dealing with a power assertive rapist who is starting off with a softer approach. Try nonviolent tactics, crying, pleading, praying aloud while you're sizing up the assailant. If it works you may be able to escape the situation. But if he responds by becoming verbally abusive or degrading, he is likely a power assertive rapist and you will have to evaluate whether you are capable of fighting him off. &lt;/p&gt;&lt;p&gt;"&lt;strong&gt;Women need to rely on their instincts.&lt;/strong&gt; When confronted with a rapist they will try various techniques. In this situation, take full advantage of your instincts in trying to figure out which type of rapist you are dealing with". &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Anger-excitation rapist:&lt;/strong&gt; A sadist, who derives sexual gratification from inflicting pain. He is typically charming and intelligent. The crime is premeditated and rehearsed methodically in his mind before it is attempted. His victims may or may not be strangers. He will tie, gag and blindfold them and torture them over a period of days, even recording his crimes in a diary, taking photographs or videotaping them. Just five percent of rapists fit this description. &lt;/p&gt;&lt;p&gt;Of the four types he is the most criminally sophisticated and it's difficult to catch him. He's got absolute control over you so there's no question of any type of resistance or of escaping. Oftentimes he kills his victims, either to get rid of a witness or to gratify a psychosexual need." This is probably the most dangerous situation a woman can be in. If you're tied up, you're going to have to match wits with this guy and trick him or talk him into untying you so you have at least some chance of escape. &lt;/p&gt;&lt;p&gt;Most rapists are not murderers. It is less likely that a woman - even one who has taken a women's self-defense course -- can overcome the intensity of the violence that an anger rapist will inflict. But power rapists commit nearly two-thirds of all rapes, and you have a fighting chance to fend them off. If you assess the situation and feel confident of your ability to fight or talk your way out of [being raped], go ahead and do it. &lt;/p&gt;&lt;p&gt;There are women who have yelled or fought back, whether they've taken self-defense classes or not, and have not gotten raped. To tell a woman 'don't do anything, be the passive female' is absolute (nonsense)." &lt;/p&gt;&lt;p&gt;Given that the goal of all women who are in imminent danger of being raped is to avoid it, they should rely on their instincts rather than assume that they have to submit. The sheriff is the highest law enforcement officer in the county, elected by the people to serve and protect the citizens of the county. Therefore it is imperative that he/she be well versed in the constitutional rights of the people. The sheriff is the protector of the people and the keeper of peace in the community. To accomplish these goals he/she must have the trust and support of the citizens of the county. I would like to see a strong sense of loyalty, in a sheriff, to those he/she serves. He/she should view every citizen as a friend and master. He/she should have compassion and common sense when enforcing our laws. He/she should be able to judge fairly in situations that may not always be clear and text book in their nature, always giving the citizen the respect due in any situation and not assuming guilt as a first response. He/she should be someone young and old alike can look up to and expect to protect and serve them in any circumstance where law enforcement is needed. He/she should be impartial in executing his/her duties. &lt;br /&gt;&lt;br /&gt;   The ability to do the above is not inbred in everyone. It takes a special person to fill these demands and that is why we should examine carefully the background and character of any individual wishing to serve as sheriff. Knowledge of all the laws is important and willingness to admit that he/she may have to check to make sure the particular situation is covered and the letter of the law is correct, is equally important. After all he/she is the sheriff, not an attorney.&lt;br /&gt;&lt;br /&gt;A sheriff who is quick to listen and slow to pass judgment will seldom make mistakes. I think about all these things when I put my all important mark on the ballot. I hope you do to, so we all make the right call at election time. To most of us it is the most important position on the ballot, requiring the complete confidence and trust of the people. It is your right and duty to choose wisely, so don’t blow it. Your future and your children’s future safety and security depend on your judgment on Election Day. I asked Matthew Dale, Executive Director of Victim Services at the Department of Justice and his response was;“It depends; it is a variable and not an easy answer.”&lt;br /&gt;&lt;br /&gt;WordNet® 3.0, © 2006 by Princeton University defines a victim as: 1. an unfortunate person who suffers from adverse circumstance and Webster's Revised Unabridged Dictionary, © 1996, 1998 MICRA, Inc. defines a victim as: 2. A person or thing destroyed or sacrificed in the pursuit of an object, or in gratification of a passion; as, a victim to jealousy, lust, or ambition.&lt;br /&gt;&lt;br /&gt;So, is &lt;strong&gt;a victim a “victim”&lt;/strong&gt; when a crime occurs&lt;strong&gt;?&lt;/strong&gt; When does a crime occur? Who determines when a crime has occurred? When does the victim of a crime have rights?&lt;br /&gt;&lt;br /&gt;Let’s look at this closely. Take for example your daughter, granddaughter, wife or girl friend goes out one evening with friends. A drug is slipped into her drink and she is whisked away into the night. Hours later the realization hits, and the trauma begins for both the woman involved and her family, just as it has happened &lt;span style="FONT-WEIGHT: bold"&gt;more than half a dozen times now in the Eureka area in the last year and &lt;span style="font-size:130%;"&gt;then again last weekend.&lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="FONT-WEIGHT: bold; COLOR: rgb(204,0,0)"&gt;Shocked?&lt;/span&gt; You should be! This news should have been plastered all over the county and state instead of being swept under the carpet just as the previous rapes has been.&lt;br /&gt;&lt;br /&gt;Now the story of your loved one begins to unfold and the questions start. Is there a victim here? The answer appears to be NO according to the Montana Code Annotated: 46-24-201; Services to victims of crime. If there is no crime, then there are no services available to that person according to this statute. Has a crime occurred in this scenario? No, because no charges have been made and no arrests have taken place. Then how would a crime be established? It would only be established if an investigation has taken place and evidence is collected to prove a crime has occurred. At that time charges can be filed and an arrest can be made; &lt;span style="FONT-WEIGHT: bold"&gt;NOW WE HAVE A VICTIM&lt;/span&gt;, at least according to Montana Statutes.&lt;br /&gt;&lt;br /&gt;The definition of a victim in the dictionary sense speaks of no crime but of a person who suffers from an adverse circumstance. The actual definition does not reference a crime or a perpetrator, but the Montana Statutes do. &lt;span style="FONT-WEIGHT: bold; FONT-STYLE: italic"&gt;The only authority capable of establishing the fact that a crime has occurred is the Sheriff, in the State of Montana.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;So you ask what was the extent of the investigation of the crime is in this case? Well, that is the question we are all asking in the numerous rapes, (10 that we know of) many involving drugs, battery and robbery, home and business vandalism and robberies, assaults and other crimes that have occurred all over the northeast area of Lincoln County.&lt;br /&gt;&lt;br /&gt;What ever happened in the investigation of the 5 reported rapes that included Miranda Peterson? Her story was told before the Commissioners at their October 15th meeting and reported in the Tobacco Valley News and Kootenai Valley Record. Apparently nothing and we are sure many would like these cases to just go away as well, like the brutal torture and killing of the little lab last spring. If there has been any resolution to any of these cases then why hasn’t the public been advised?&lt;br /&gt;&lt;br /&gt;If our sheriff does not do a proper investigation and collect evidence as he has been trained to do, then we have no crime and no victims. Additionally, our crime statistics reflect this with their low numbers. No investigations, no arrests, therefore, no crime!&lt;br /&gt;&lt;br /&gt;So where does this leave the woman that has been violated? Her life has changed forever and the devastating aftermath to her family, friends and the community has created tremendous pain and hardship. Where are her rights as a victim? Where are her rights to due process of law under both the Montana and United States Constitution?&lt;br /&gt;&lt;br /&gt;The plain truth is they have been stripped away because our sheriff has voluntarily failed to do his job. He failed to fully investigate these crimes in a manner in which he has been trained to do so. His failure to fulfill his duties and obligations as an enforcement officer in this county has resulted in the loss of these victim’s rights, their dignity in the community and their right to due process of the law.&lt;br /&gt;&lt;br /&gt;His incompetency has allowed these criminals to continue to repeat their behavior over and over again affecting the lives and homes of innocent women and their families and denying them any and all rights as a victim.&lt;br /&gt;&lt;br /&gt;How many more “victims” should we as a community tolerate? ONE was too many for me! But 10 rapes? Folks, this is Eureka, Montana and we should all be embarrassed and ashamed that we as voting citizens have allowed this to happen, over and over again.&lt;br /&gt;&lt;br /&gt;Isn’t it time for Lincoln County take back its pride, its dignity and do every thing in our power to make our county safe, free from vicious predators and violent behavior?&lt;br /&gt;&lt;br /&gt;In the next few weeks we will be out with a petition to recall Sheriff Daryl Anderson. It appears that the Sheriff is the highest authority in the land and NO ONE has authority over him. This is very clear in the attached letters from the Governor, Attorney General, Montana Supreme Court and Division of Criminal Investigations.&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="color: rgb(255, 255, 255);"&gt;a&lt;/span&gt;&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;These letters inform us that because a crime occurs under the jurisdiction of the local law enforcement agency, nothing can be done. So if the local law enforcement people are incompetent, lazy or vindictive, then so be it. The victims of these crimes have NO RIGHTS because Governor and every other agency in the state have no authority to protect them. Every state agency we have contacted has referred us to another one.&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;span style="color: rgb(255, 255, 255);"&gt;a&lt;/span&gt;&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt; Is no one accountable? What’s wrong with this picture? Is &lt;st1:place st="on"&gt;&lt;st1:state st="on"&gt;Montana&lt;/st1:state&gt;&lt;/st1:place&gt; really being run as a Feudalistic state? &lt;st1:place st="on"&gt;&lt;st1:placetype st="on"&gt;County&lt;/st1:placetype&gt;
